General Data: The use of our services will automatically create information that will be collected. For example, when you use our Services, your geographic location, how you use the Services, information about the type of device you use, your Open Device Identification Number, date/time stamps for your visit, your unique device identifier, your browser type, operating system, Internet Protocol (IP) address, and domain name are all collected. This information is generally used to help us deliver the most relevant information to you and administer and improve the Site. 

Log Files: As is true of most websites, we gather certain information automatically and store it in log files. This information includes IP addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to maintain and improve the performance of the Services. 

Analytics: We use analytics services (including, but not limited to, Google Analytics) to help analyze how users use the Site. Analytics services use Cookies to collect information such as how often users visit the Site and we use the information to improve our Site and Services. Pico Digital Marketing (“Pico” or “Pico Digital” or “We” or “Us”) respects our customers (“Users”) concerns about privacy. We understand that visitors to our website may have questions about whether and how this website collects and uses information, and are committed to protecting your privacy. We only use the personally identifiable information (“personal information” or “personal data”) that you provide in accordance with the terms outlined below.

Personal Information

Users may be asked for, as appropriate: name, email address, phone number, and company name.

Users may, however, visit our Sites anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Sites related activities.

Personal information will be kept for up to 180 days.

Non-personal Information

We may collect non-personal identification information about Users whenever they interact with our Sites. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Sites, such as the operating system and the Internet service providers utilized and other similar information.

Web Browser Cookies

We collect information about how you use our Sites by setting and accessing cookies on your computer. A cookie is a small piece of information sent by our Sites that is saved on your hard drive by your computer’s browser. The cookie holds information our Sites may need to personalize or enhance your experience and to gather statistical data, such as which pages are visited, the internet provider’s domain name and the addresses of the sites visited immediately before coming to and immediately after leaving the Sites. The information in the cookie lets Pico trace “clickstream” activity (i.e., the paths taken by visitors to our Sites as they move from page to page) to enable us to better serve our customers by revealing which portions of our Sites are the most popular. We may link the anonymous visitor ID from your cookie to a user ID in our database to help us analyze web traffic and statistics. From time to time, other companies may help us with data research and analysis, but they will be prohibited from using that data for any other purpose. You may disable cookies on your browser. Pixel Tags

We may use pixel tags (also called web beacons or clear gifs) on our Sites. They can help us analyze what our customers do on our Sites and the effectiveness of our features and advertising. They can also help us customize your browsing experience. We may use information collected through pixel tags or tracked links in combination with your personal information. We may also combine personal information you provide to Pico with other personal information. If we work with other companies to help us track, collect, and analyze this information, they will be prohibited from using this information for any other purpose.

We may collect personal information from Users in a variety of ways, including when Users: visit our site, subscribe to our newsletter, fill out a form, and/or in connection with other activities, services, features, or resources we make available on our Sites.

In 2019, we collected personal information via Sites usage, newsletter subscriptions and form fills. This information included name, email address, company name, and telephone number. We also collected cookie data as outlined in Section 3 of this policy. We did not sell this information to any third party. The information was used in accordance with Section 5 of this policy.

  1. How We Use Collected Information

Pico collects and uses Users personal information for the following purposes: to personalize user experience, to improve our Sites, to improve customer service, to share your information with third parties, to send Users information they agreed to receive about topics we think will be of interest to them, and if a User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or User may contact us via our Sites.

We may also use information in the aggregate to understand how our Users as a group use the services and resources provided on our Sites.

  1. How We Protect Your Information

We adopt appropriate data collection, storage and processing practices, and security measures to protect against unauthorized access, alteration, disclosure, or destruction of your personal information and data stored on our Sites. We do not collect any sensitive or purchase-related User information.

  1. EU-US Privacy Shield

If you are providing your information from the European Union, Pico complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data transferred from the EU to the United States. Pico has certified to the Department of Commerce that we adhere to the Privacy Shield Principles. If there is any conflict between the terms in this Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. To learn more about the Privacy Shield program, the Privacy Shield Principles, and to view our certification, please visit https://www.privacyshield.gov/. Our participation in the Privacy Shield applies to all personal information that is received from the European Union and European Economic Area.

Pico remains responsible and liable under the Privacy Shield Principles for onward transfers if third-party agents that we engage to process personal information on our behalf do so in a manner inconsistent with the Principles unless we can prove that we are not responsible for the event giving rise to the damage.

In compliance with the Privacy Shield Principles, Pico commits to resolve complaints about our collection or use of your personal information.  EU individuals with inquiries or complaints regarding our Privacy Shield policy should first contact Pico at info@choosepico.com

We have further committed to refer unresolved Privacy Shield complaints to JAMS (Judicial Arbitration and Mediation Services, Inc), an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please or visit https://www.jamsadr.com/eu-us-privacy-shield for more information or to file a complaint.  The services of JAMS are provided at no cost to you.

For all complaints left unresolved by all other available mechanisms, you may invoke binding arbitration with the Privacy Shield Panel, which consists of a pool of 20 arbitrators designated by the Department of Commerce and the European Commission, from which the parties will be able to select either one or three arbitrators.

Pico is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission (FTC).

You have the right, without discrimination, to be provided with information as to the nature of the personal information stored or processed about you by Pico and may request deletion or amendments.

If access is denied, you have the right to be informed about the reasons for the denial. You may resort to the dispute resolution described in this policy as well as in any competent regulatory body or authority. Pico shall handle in a transparent and timely manner any type of internal dispute resolution procedure about personal information.

If any information is inaccurate or incomplete, you may request that the data be amended. It is your responsibility to provide us with accurate personal information about yourself and to inform us of any changes. (e.g. new home address or change of name).

If you demonstrate that the purpose for which the data is being processed in is no longer legal or appropriate, the data will be deleted, unless the applicable law requires otherwise. You also have the right to request the deletion of your personal data for any reason by emailing info@choosepico.com. Exceptions to deletion may include, where necessary: complete a transaction/perform a contract; security purposes; debugging; free speech; comply with CECPA; research in the public interest; consumer expected internal uses; a legal obligation; and lawful and compatible internal uses.

If you are a California resident, you have the right to request information from us regarding the manner in which Pico shares certain categories of personal information with third parties for their direct marketing purposes, in addition to the rights set forth above. Under California law, you have the right to send us a request at the designated address listed below to receive the following information:

  1. The categories of information we disclosed to third parties for their direct marketing purposes during the preceding calendar year;
  2. the names and addresses of the third parties that received the information; and
  3. if the nature of the third party’s business cannot be determined from their name, examples of the products or services marketed.

Also, please note that we have not yet developed a response to browser “Do Not Track” signals, and do not change any of our data collection practices when we receive such signals. We will continue to evaluate potential responses to “Do Not Track” signals in light of industry developments or legal changes.

We will respond diligently and appropriately to requests from DPAs about this Policy or compliance with applicable data protection privacy laws and regulations. We will, upon request, provide DPAs with names and contact details of the individuals designated to handle this process. With regard to transfers of personal information, we will (i) cooperate with inquiries from the DPA responsible for the entity exporting the data and (ii) respect its decisions, consistent with applicable law and due process rights. With regard to transfers of data to third parties, we will comply with DPAs’ decisions relating to it and cooperate with all DPAs in accordance with applicable legislation.
